The Codes of Digital Engagement serves as the Terms of Use and Privacy Policy for The Internet Press LLC.The Code
At the Internet Press (Press), we believe these Codes of Digital Engagement (Code, Codes) should apply to all the internet when sharing content to its services. Our jurisdiction resides within the use of The Internet Press and users of The Internet Press must adhere and abide by these guidelines. These Codes serve as the Terms of Use ('Terms') and the Privacy Policy of The Internet Press.
Title 1. General Provisions
These provisions apply to all Titles, Codes, and Subsections of the Code.
§1.1. Definitions
These definitions apply to all Titles, Codes, and Subsections of the Code.'Press', 'we', 'us', 'our' – refers to and means The Internet Press LLC, a Cincinnati, Ohio company.
'§' – denotes a subsection or code of these Codes, 'Subsection' means a part of a section, or Title (title), of these Codes.
'Business' – is a legally recognized entity by the presiding jurisdiction this service in use is operating in and the user presides in.
'Codes','Terms','Privacy Policy','Code(s) of Digital Engagement', and 'The CODE' – refers to this document and the content herein.
'Channel' or 'Category' – is a category of content that has a common theme like 'Sports' or 'Entertainment' to which content is assigned to.
'Entity' – is anything but a human.
'Interface' – is anything user facing interface, software or app, that serves as a means to use this service.
'Organization' – is a legally recognizable entity like a 'Business' or 'Non-profit'.
'Account', 'profile', 'user' – are synonymous; hereinafter referred to as 'profile(s)'; meaning a set of information a human or an entity owns, and such represents that human or entity with the intent to use this service.
'Malicious intent' – refers to any deliberate action or behavior aimed at causing harm, disruption, or damage to any human or entity.
'Non-profit'– is an entity that bears the proper registration of a 501(3)(c) entity in the United States or an alternative recognition of the presiding jurisdiction if not the United States.
'Post' or 'Message' – means to share or submit information to this service with intent to do so and with the understanding that it may be saved on a remote server on the internet; or is a willful transmission of content to a service that is meant to be shared with other profiles belonging to that service or which is to be publicly shared.
'Profile', 'user', 'account', 'you', 'press' – is a page of the Press that reflects your information and gives you control over the use of The Internet Press
'Robot(s)', 'Bot(s)', 'Script(s)' – is an automated computer, script, or service that is created with the intent to use a service on the internet
'This service' – means The Internet Press or any service or business that adopts these Code.
'Porn' – is any material that shows any person's nude in any fashion or with any exposed extremities.
'Content shared', or 'share(d)' – means any information submitted to this service.
§1.2. Liability Clause
To the fullest extent permitted by applicable law, in no event shall The Internet Press, its affiliates, directors, employees, agents, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:1. your access to or use of or inability to access or use the Service;
2. any conduct or content of any third party on the Service;
3. any content obtained from the Service;
4. the adoption of these Codes;
5. and, unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
§1.3. Service Review Board
There shall be a committee created by this service that is responsible for assessing these Codes. This committee shall be called the 'Service Review Board'. This committee shall be made up of an odd number of participants, one of whom shall serve as the Governor and is chosen by a simple majority of the participants. This service review board shall be responsible for:a. Review, approve, and decline Code violation assessments and appeals.
b. Review, approve, and decline content that violates these Codes.
c. Review, approve, and decline changes to these Codes.
§1.4. Changes to the Service Review Board
The Service Review Board, through a simple majority of the members therein including the Governor, may add or remove members of that committee. All decisions of the Service Review Board to modify its membership must be approved by the Board of Directors of this service.Title 2. Declination and Acceptance of these Codes
This Title outlines how you show The Internet Press your acceptance of these Codes.
§2.1. Exemplification of Acceptance
The use of this service, and continued use thereof, exemplifies your acceptance of these Codes for this service§2.2. Exemplifications of Declination
To exemplify your declination to accept these Codes, you immediately must stop the use of this service and the content in this service. Report yourself for violating this Code and we will contact you§2.3. Right to Contest
You reserve the right to contest these Codes by visiting our support page and following the process there. Raising a contest of these Codes requires support of your allegation in the contest and reasonable concern for why the Code in question should be modified or removed.Title 3. Adherence to these Codes
§3.1. Right to Report
Profiles reserve the right to report any content or profile for violating these Codes.§3.2. Prohibition of False Reporting
False or retaliatory reports are prohibited.§3.3. Reservation to Assess Fines
Fines may be assessed to profiles violating these Codes.§3.4. Fine Frequency
Fines are only imposed on a profile if the administrator deems necessary or the violation is a repeated offense. A fine may not be assessed to the same profile more than once a fortnight.§3.5. Due Process Clause
Violations of these Codes are determined by this service's administrators or content moderators. Violation of these Codes is predicated on a guilty verdict for the infringement of the specified code violation. No profile shall be found guilty without due process.§3.6. Double Strike Policy
The second violation of a code will result in the assessment of double the original fine.§3.7. Third Strike Policy
Violation of the same code along with guilty verdicts for a third time will result in the suspension of your profile for a sufficient period and a $100 fine.§3.8. Termination from Code Violation
Violation of the same code along with guilty verdicts for a fourth time will result in the immediate termination of your profile and a lifetime band from Press. This service also reserves the right to suspend or terminate your profile under extraneous circumstances.§3.9. Fine Funds Allocation
Any fines assessed for violations of these Codes are to be allocated to this service's donation fund.§3.10. Right to Appeal
Profiles reserve the right to appeal any guilty verdict Code violation a single time. If the appeal is accepted and the verdict is discharged, the reporting profile will be found guilty of violation of §4.2. herein.§3.11. Failure to Appeal
If a profile has failed an appeal, still believes they did not violate these Codes, and were assessed fines for the violation, it may appeal the assessment of fines, not the guilty verdict.§3.12. Non-payment Suspension
If the assessment of fines is not appealed, a profile may choose to not pay these fines. If a profile decides to not pay fines that were unsuccessfully appealed, that profile has signified their intent to discontinue the use of Press and their profile will be suspended until the fine(s) is paid.Title 4. Arbitration
§4.1. Arbitration Clause
This service reserves the right to handle any arbitration or legal dispute concerning the use of this service with an arbitrator or mediation where applicable by the presiding jurisdiction.§4.2. Agreement to Arbitrate
In the event of any dispute, claim, or controversy arising out of or relating to this agreement, or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, such dispute, claim, or controversy shall be resolved by arbitration in accordance with the rules of the American Arbitration Association.§4.3. Arbitrator's Authority
The arbitrator shall have the authority to grant any remedy or relief that would have been available in a court of competent jurisdiction.§4.4. Confidentiality
The parties agree that the arbitration shall be kept confidential and that the existence of the arbitration proceeding, any element of it, or any documents, testimony, or other information disclosed during such proceeding shall not be disclosed beyond the arbitration proceeding, except as may be necessary to seek confirmation of the award or as required by law.§4.5. Arbitration Costs
Each party shall bear its own costs and expenses related to the arbitration, and the parties shall equally share the fees and costs of the arbitrator.§4.6. Arbitration Award Finality
The award rendered by the arbitrator shall be final and binding on the parties and may be entered in any court of competent jurisdiction for enforcement.§4.7. Full Force and Effect
If any provision of this arbitration clause is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.Title 5. Use of and Account Creation For
§5.1. Use of an Illegal Entity
Only humans, terrestrials, and organizations may create a profile for this service.§5.2. Submission of False Information
All information provided to this service, or any other service on the internet, must and should be true and factual to the best of your ability.§5.3. Malicious Autonomy (Bots)
Robots and scripts whose sole purpose is to automate activity on an internet service, specifically The Internet Press, are banned for life from the usage and profile creation of this service if the robot or script does not intend to contribute to the service in a positive way, harbors malicious intent, and or violates these Codes.§5.4. Profile Creation with Malicious Intent
Profile creation with malicious intent or false information is prohibited. This will result in a lifetime banishment from this service.§5.5. Illegal Submission of Information
You are the owner of the information and content you submit to this service before and after submission to this service or have been given permission for such use. This service MUST request your permission to use information given by you for purposes other than prescribed herein or what is the minimum information required for this service to operate except whereas:a. You are representing an entity and have been granted permission to use information you are not the owner of.
b. You are an entity using information you are not the owner of, but you have been given explicit permission to reuse aforementioned information by the original owner, even if you do not represent the entity whose permission was given.
c. You are an entity using information that is within the public domain of information and has not been extraneously duplicated on this service. There can only be so many profiles dedicated to cats.
§5.6. Illegal Use of Information
Illegally obtained information or information that you have not been given permission to share, must not be shared on this service until sufficient permissions have been obtained. This service reserves the right to remove any information that was illegally obtained or shared to this service.§5.7. Insufficient Permissions Obtained
Only the owner of the information provided to this service may grant permission for such use prescribed in this Title. This service may request for proof of permission to share for any content shared to this service.§5.8. Limit Duplicitous Profiles
Do not create duplicitous profiles with respect to the profile's purpose or content shared. This service reserves the right to remove profiles deemed as duplicitous and that do not contribute to this service in a positive way. This profile reserves the right to decline profile applications and memberships if it is deemed the profile would be duplicitous in this service.Title 6. Posts, Content and Ownership
§6.1. Sufficient Post Permissions
You must have permission to post or share the content you are posting or sharing to this service, or the internet, from the content's original owner or creator.§6.2. No Sexually Explicit Content
Content shared on this service, or any service on the internet, CANNOT contain:any pornographic material;
calls for violence against or threats to a human, a group of humans, or an entity;
sexually explicit content about or involving another human, a group of humans, or an entity.
§6.3. Excessive use of Vulgar Language
Content shared on this service, or any service on the internet, must refrain from EXCESSIVE use of vulgar language and profanity.§6.4. Contains Personal Information
Any content shared cannot share personally identifiable information of another profile without that profile's permission. Sharing this information without the owners consent is a violation of this subsection.§6.5. Sharing Third-party Content
Content shared that uses third-party information, data, or services, and use thereof must adhere to that party's Terms of Use and Privacy Policy as well as these Codes of Digital Engagement.§6.6. False Information
This service reserves the right to label content provided to this service as 'Speculative' if its content is suspicious or false. This service reserves the right to remove content that is false AND harbors malicious intent. We express caution on this subject. Censorship is never the answer. If you do not like it (the content) but it is true, there is no support for removal. Reporting content as false when in fact it is not will result in the reporting profile be found guilty of violating §4.2.§6.7. Due Diligence
Though this service cannot force all profiles to abide by standards and the intent of the CODE is not to be big brother but an issue today is that people are quick to press the submit button. Even if your content does not violate the CODE, please do your due diligence in research and intent. Let's keep Press unique and flavourful.§6.8. Artificially Generated Content
This service may allow content to be submitted or shared to this service that is created by Artificial Intelligence or Large Language Models but must be labeled as such when being presented to other profiles and must be an ethical use thereof and must adhere to these Codes.§6.9. Mislabeling of Content
Any content shared to this service that requires labeling as prescribed by these Codes must be accurately labeled accordingly. Content that is not accurately labeled my be removed from this service or adjusted to reflect the proper content labeling.§6.10. Shared Content Availability
Unless your profile has been set as a Private profile, the content you share to your profile is publicly available for access and viewing to all profiles in this service. This service must enable the ability to make a profile private to protect the privacy of individuals who desire to do so.§6.11. Profile Right to Purchase
This services makes available an opportunity to pay a minimum of $12 per annum to retain the ownership rights of your profile name like an internet domain. If a profile is owner, the owner reserves the right to:1. Resell that profile name at any value greater than the original annual price the profile name was acquired for.
2. Include the profile's information and content shared therein when that profile name is resold.
3. Remove or download the entirety of their profile except the profile name.
§6.12. Profile Resell Repayment
If a profile name is resold at a value greater than what it was originally paid for, the resell price is now the new annual membership that must be paid by that profile's owner annually to retain ownership of the profile name.§6.13. Profile Property Ownership
The creator of a profile maintains ownership of that profile and the content they have shared therein until that creator deletes their profile ad their profile name will be made available again as a new profile.§6.14. Content Removal Reservation
This service and its administrators reserve the right to remove any content shared on this service that violates these Codes.Title 7. Information Collection and Sharing
This Title outlines the 'Privacy Policy' of these Codes. Privacy must be one of the greatest priorities for this service and this service should maintain a good relationship with you.
§7.1. Cookie Policy
This service may use Cookies to retain information in your browser like session information to facilitate the proper processes necessary to make this service work.§7.2. Exact Location Usage
This service may use or collect your exact location, latitude and longitude coordinates and or address, in or during:a. you are sharing content with the intent to include your location.
b. you are posting content to the 'Explore' channel on Press with a location.
c. physical mail is being sent to you from this service to your address that only you provide and is never automatically obtained.
d. ads that may use only your zip code and are funded by third-party profiles on Press.
e. for weather forecast in any presentation or delivery format and timezone.
§7.3. Divestment of Location Information
Profiles or third-parties misusing the exact location information of another profile will be found in violation of this subsection and may face a fine of up to $20 to continue use of Press. Misuse of location information is constituted by any of the following:a. sharing any location information you are not the owner of, or that does not pertain to you, or have not been given permission to do so.
d. selling of any location information you are not the owner of, or does not pertain to you, or have not been given permission to do so.
c. sharing or selling any information with or to a third-party service and you are not the owner of that information.
§7.4. Basic Location Required
To verify your identity and profile, Press requires a location be provided when applying to join. The location you provide will be textually visible to other profiles of the Press but is turned into a postal code for the 'Explore' page and the weather widget. This information only includes:City and State in any traditional or recognizable format.
Zip/postal code assumed from a database of city/state and respective zip code matches.
§7.5. Internet Provider Information
This service may use information provided by your Internet Service Provider (ISP) to verify your logins and sessions. Information we may save or use from ISP's are:a. Your Internet Protocol (IP) Address (continent, country, etc.).
b. location of where your internet service is provided from.
c. the timezone your internet service or ISP is located in.
d. ISP information like provider name, etc.
e. Download, upload, and round-trip speeds.
§7.6. Usage Tracking Reservation
This service reserves the right to track your use and engagement within this service but is limited to:a. The times and durations of your visits (sessions(s)) to and use of any Interface of this service.
b. City and or state of your session(s)
c. When and where you view a channel or post with respect to the allowed location information in accordance with these Codes .
d. When and where you post content to this service on a post with respect to the allowed location information in accordance with these Codes.
e. When and where you comment on a post with respect to the allowed location information in accordance with these Codes.
§7.7. Profile Interest Use
This service may use your activity of this service to gauge your interests for ad targeting but is limited only toa. Zip or postal code
b. City and or state
c. Channel (categorical) interests of press based on visit and post activity to that channel.
d. Content you have viewed
§7.8. Data Retention
To comply with many global data policies, this service must and reserves the right to retain any information submitted to, collected from or created in this service for the legally required amount of time with respect to the jurisdiction the use of this service is in.An organization shall keep the information of a profile no longer than a year after their last active date if the profile is inactive on this service for a period no less than 365 calendar days.
A service must verify contact information no less than once a year. This means verifying contact information other than two-factor authentication.
This service must retain the data of deleted profiles for not more than two years in a back up of this services' data.
This service must make available to each profile the ability to download that profiles' data and its entirety from this service.
Title 8. Payments and Subscriptions
§8.1. Payment Terms
The Internet Press uses Stripe Inc. as the payments provider and processor in the Web App version of the Press service. If purchases or payments are made on iOS or Android, The Internet Press utilizes the payment processing features in the SDKs of the mobile operating systems provided therein. Entities may request an alternate method of payment such as ACH or pay-by-check if their payment exceeds the amount of $1,000 USD or the entity is legally required to receive an alternate method of payment.§8.2. Payment Cadence
The Internet Press follows standard operating procedures for payment processing. When you submit a new payment or a payment method to this service, payment may not be fully completed until three business days following the payment submission. All payments are auto withdrawn on their prescribed due date unless the profile owner requires separate different payment terms or has already established a separate payment date or terms with the Service Review Board.§8.3. Payment Disputes
In the event of a payment dispute, Press relies on our payment processors to handle any fraudulent activity on your account or profile. Press prioritizes fraudulent charges and will not handle disputed payments that are a result of:a. forgetting to cancel a recurring payment (subscription);
b. contesting a recurring charge for a profile on the basis of amount when the profile has been resold at a higher than standard price;
c. and any charge completed but disputed because it has resulted in a users negative balance in their bank account.
§8.4. Payment Refunds
The Internet Press will not offer refunds except where:a. you have incurred a charge from The Internet Press that can be verified as fraud.
b. you have cancelled an intentional charge, subscription, or other payments at least 24 hours prior to the date due or date executed.
Title 9. Membership
This Title outlines the additional features, capabilities, and rights a profile may have with this service if they pay for a premium membership as well as the Terms around using payments in this service.
§9.1. Profile Ownership
If a profile pays for the premium membership to this service, they own the copyright and reserve the right to resell their profile name.§9.2. Expanded Abilities
As a paid Press Member, you will have the ability to:1. Promote your posts on The Internet Press, otherwise known as Advertising
§9.3. Non-Payment
Failure to pay the membership fee on the recurring date of subscription will result in:termination of your premium membership to this service.
termination of your ownership of your profile name.
termination of your ability to resell your profile name.
termination of the additional features in this service enabled when subscribed to this services' premium membership.
Title 10. Updates to this Service
Apps and services should always provide updates whether they are security patches or additional features. This Title outlines the way Press believes companies should deploy updates and inform their visitors. Updates may be provided in any manner.
§10.1. Update Classification
It's important to classify updates we provide to our services because some do not quite effect all profiles, some change the way this service is intuitively used.Level 1 – Minor updates to the framework of this service for performance or security.
Level 2 – Updates to this service that add features.
Level 3 – Updates to this service that may require an outage on any server node and or includes a UI change.
Level 4 – Updates required for security or other emergency purposes.
§10.2. Deployment of Updates
This service shall deploy updates to production in accordance with the form subsections Update Classification(s) as follows:Level 1 – Updates deployed as needed and should not interrupt this service.
Level 2 – Updates deployed no more than seven calendar days after users of this service are notified of such update and its contents.
Level 3 – Updates deployed no more than one calendar day
Level 4 – Updates are deployed immediately if necessary notwithstanding the potential for service delay or interruption due to security, performance, or resilience requirements.
Title 11. Global Compliance
§11.1. GDPR
This service must comply with the General Data Protection Regulation ('GDPR') set forth by the European Union.§11.2. CCPA
This service must comply with the California Consumer Privacy Act set forth by the State of California in the United States.Title 12. Service Reporting
§12.1. General Reporting
From time to time, this service shall publish reports that reflect its growth, privacy, security and financials.§12.2. Content Use in Reporting
This service may use any information or content provided to or existing in this service for reporting purposes without any personally identifiable information.Title 13. Donations and Profit Sharing
§13.1. Profit Allocation Pledge
The Internet Press, to have a true positive impact on society, pledges to donate and share a portion revenue once profitable.§13.2. Donation Provisions
This service may create funds accounts to which revenues may be allocated. The Internet Press shall have funds accounts allocations as follows:Donations Fund – Any currency contributed from visitors to this service through means that designate the intent to donate shall be allocated to a Donations Fund that may only be donated and may not be considered revenues.
Revenues Fund – A percentage of any currency contributed from subscriptions to this service shall be allocated to a Revenues Fund with the intent to donate those funds in accordance with these Codes once this service become profitable.
Emergency Fund – An emergency fund shall be established which may be contributed to and from other funds whose purpose is to fund aid to those in need during a State of Emergency as established and proclaimed by the presiding jurisdiction.
§13.3. Donation Frequency
Donations are made monthly. Each month's donation fund is based on the previous month's profit, fines, and or donations funds.§13.4. Profit Sharing Frequency
Profit sharing is made monthly. Each month's profit-sharing fund is based on the previous month's profit excluding donations and fines.§13.5. Profit Sharing Amount
The total amount of profit to be shared shall be determined by the content moderators and or the administrators.§13.6. Fines for Donations
Any fines assessed in accordance with these Codes are to be allocated to the donation fund.Title 14. Adoption of these Codes
The Internet Press makes these Codes available for adoption by any organization. We believe it is a broad safe set of standards all can and should comply with.
§14.1. Adoption Availability
Third party entities may adopt these Codes in accordance with their charter or bylaws.§14.2. Adherence of Adoption
Adoption of these Codes signifies intent of compliance to all Codes herein.§14.3. Failure to Adhere to Adoption
Adoption of but non-compliance to these Codes will result in monetary fines and or suspension or termination of your membership with The Internet Press. Adoption of these Codes signifies your agreeance with the repercussions of this clause. The Internet Press reserves the right to arbitrate failure to comply to adoption adherence of these Codes.§14.4. Denial of Changes to Adopters
Adopters of these Codes may not make changes or appendages to these Codes.§14.5. Cost of Adoption
Any organization is free to adopt these Codes but The Internet Press may charge a prescribed amount in the future as a requirement to adopt these Codes whenever deemed necessary.§14.6. Adoption Abandonment
Adopters of these Codes may choose to abandon such adoption without notice to The Internet Press and without delay.Title 15. Changes to these Codes
§15.1. Frequency of Changes
The Internet Press (Press) reserves the right to make changes to these Codes at any time without approval from adopters§15.2. Adherence of Adoption
Changes to these Codes shall be in effect 28 calendar days from their introduction to the entirety of Press profiles.§15.3. Profile Adherence of Changes
Profiles under the jurisdiction of these Codes when a change to these Codes is implemented, may:a. signify their declination of such changes by immediately discontinuing their use of this service.
b. signify their acceptance of such changes by continuing their use of this service.
c. contest such changes by contacting support.
